Colorado's Misrepresentation Law, Element by Element

C.R.S. 18-13-107.3 targets people who fake entitlement to an assistance animal to get housing accommodations. All of these must be true:

  • 1The person intentionally misrepresented entitlement to an assistance animal to obtain housing rights.
  • 2The person had already received a written or verbal warning that doing so is illegal.
  • 3The person knew the animal was not an assistance animal for them, or knew they had no disability.

Vests and Patches: Helpful, Never Required

A vest reading "working" can stop strangers from petting a service dog. It does not prove training, and an untrained dog in a vest gains no rights.

What a Landlord Can Actually Verify

Registry numbers lead back only to the company that sold them. A Colorado housing provider checking your paperwork has better tools.

The clinician's name, license type and number through a state licensing lookup, and a way to confirm the letter came from them.

An ID card photo, a registry lookup page or a "lifetime certification" date.

The Only Dog "Registration" Colorado Mentions

Ordinary city and county pet licensing still exists, and it is not about disability. Colorado exempts an individual with a disability who owns a service animal from state and local licensing fees for that animal.

In practice

Ask your local licensing office, such as a humane society under city contract, how it applies the fee exemption.

The exemption covers fees. It does not remove vaccination rules or leash laws, and it does not apply to emotional support animals.

What Legitimate Documentation Involves in Colorado

Colorado's licensing statutes describe the clinician's job in concrete terms. After meeting the patient as the statute for their license requires, the clinician makes one of these written findings:

Disability finding. Whether the patient has a disability.
Need finding. If so, a separate finding on whether the need for the animal relates to that disability.
Or: insufficient information. A written finding that there is not enough information to decide.

Mental health licensees and nurses must have met the patient in person; physicians may also use telemedicine.

Can I register my emotional support animal in Colorado?

There is no official ESA registry in Colorado or at the federal level. Websites that sell registration numbers or certificates are private businesses, and what they sell does not create housing rights.

Is an ESA certificate enough for a Colorado landlord?

No. A landlord may ask for reasonable documentation of a disability and the need for the animal, which a certificate cannot show. A written finding from a qualified clinician can.
