Indiana ESA laws and what approval saves you

Indiana adds no waiting period and no unusual documentation rules, which makes this the most practical question for Hoosier renters: exactly which charges stop when the accommodation is approved, and which ones do not.

Asking Indiana management for a credit

Plenty of Indiana tenants pay pet rent for months before learning it should not have applied after approval. Ask politely, in writing, and anchor it to the approval date rather than arguing the law in the abstract.

Subject: Pet charges after approved assistance animal accommodation

Dear [property manager],

My reasonable accommodation for an assistance animal at [address] was approved on [date]. Since then I have been charged [pet rent / a pet fee] of [amount] on [dates].

Charges applied because an animal is a pet do not generally apply to an approved assistance animal. Please remove this charge going forward and confirm how amounts already paid will be credited.

I remain responsible for any actual damage, and I am happy to discuss that separately.

The twelve-month arithmetic

What Indiana pet charges add up to

Indiana does not cap security deposits by statute, which makes the pet addendum the place where costs quietly accumulate. Set against a year, the numbers explain why this section matters more than the legal theory above it.

Pet rent

Monthly

Charged per animal, every month, for the life of the tenancy. Removed on approval.

Pet deposit

Once

Refundable in principle, frequently reduced by animal-related deductions in practice. Removed on approval.

Pet fee

Once

Non-refundable by design, so never seen again. Removed on approval.

Security deposit

Once

Charged of every tenant regardless of any animal. Entirely unaffected.

Damage

At move-out

Your responsibility in full. Indiana landlords retain every ordinary remedy.

An approved accommodation removes the first three lines. It does not touch the last two, and no honest provider will tell you otherwise.

Renewal, expiry and the cost of letting it lapse

Indiana attaches no expiry date to ESA documentation — the Civil Rights Law is silent on the point and IC 16-32-3 concerns access rather than paperwork. The cost of a stale letter is therefore practical rather than legal, and it is paid in exactly the charges listed above.

1

Letter goes stale. Twelve months pass; the leasing office notices at renewal.

2

Accommodation is queried. Documentation is requested again, this time under time pressure.

3

Pet charges reappear. The billing profile reverts while the query is open, and the arithmetic above starts running again.

4

You are negotiating from behind. All of which a ten-month renewal would have avoided entirely.

If you moved to Indiana, note that landlords check the licence jurisdiction — documentation from an Indiana-licensed clinician is what withstands that check.

Different pathway

Psychiatric service dogs in Indiana

Indiana follows the ADA for public access, and Indiana Code 16-32-3 addresses service animals at state level. Indiana separately treats misrepresenting a service animal as an infraction.

Service dog status comes from individual task training. A PSD evaluation supports the disability side of that; it does not train, test or register the animal.

Quick check

Indiana fees fall away for both categories in housing. Public access is where the two diverge sharply.

Indiana questions

Asked most often in Indiana

What does an approved ESA request save me in Indiana?

Pet rent, pet deposits, non-refundable pet fees and breed or weight surcharges generally stop applying to an approved assistance animal. Over a year that is frequently several hundred dollars. Your ordinary security deposit and liability for actual damage are unaffected.

Can an Indiana landlord keep charging pet rent after approval?

No. Charges that exist because an animal is a pet do not apply to an approved assistance animal. Ask in writing for the charge to be removed and for already-paid amounts to be credited, referencing the approval date.

Who investigates housing discrimination in Indiana?

The Indiana Civil Rights Commission enforces the state civil rights law, and HUD handles the federal route. Indianapolis also has its own local office for some matters.

Does Indiana require a waiting period for an ESA letter?

No. Indiana imposes no minimum client-provider relationship. The clinician must hold an Indiana licence and the evaluation must be genuine.

My Indiana lease says pets over 40lb are banned.

A weight restriction is a pet rule, so it usually stops applying once the animal is approved. Any objection has to concern that individual animal\u2019s actual conduct.

How long does an ESA letter last in Indiana?

Not legally. Indiana has no provision expiring assistance animal documentation. Leasing practice has produced its own annual standard, which matters because it is what actually gets applied.

How long does it take to get an ESA letter in Indiana?

The eligibility screening takes a few minutes. After that a Indiana-licensed professional reviews your intake, and approved documentation is commonly delivered digitally within about 24 to 48 hours. Additional questions extend the timeline, and a process that never asks any is the one to worry about.

Can my ESA letter come from a clinician in another state if I live in Indiana?

Effectively yes, they are state specific. The professional must be licensed to practise in Indiana, which is exactly why instantly issued out-of-state letters fail here so consistently.

Do Indiana landlords accept ESA ID cards or registration numbers?

There is none. No Indiana agency registers assistance animals or issues certificates, and sites selling registration numbers are selling accessories rather than rights. What decides the request is the signed letter, nothing sold alongside it.

Can I have more than one emotional support animal in Indiana?

There is no numerical limit in Indiana law. Several animals can be supported if the need genuinely reaches each one, and each may be asked about. Naming each animal individually gives the request far more resilience.
