California ESA laws and the 30-day rule

California is the strictest ESA state in the country. Before a letter can be issued you must have had a relationship with the provider for at least thirty days — which makes every "instant California ESA letter" advertisement legally suspect.

How AB 468 actually works

Thirty days is a floor, not a formality

The statute requires that the client and provider have had a relationship for at least 30 days before documentation is issued. Starting early is the only way to have a letter ready when a lease deadline lands.

    Free screening and intake

    You complete the eligibility screening and clinical intake. The relationship with a California-licensed provider begins here, so the sooner this happens the sooner the window closes.

  2. Days 1–29

    Clinical relationship and follow-up

    The provider reviews your case and may ask follow-up questions. This period is the substance of the requirement — it exists so a letter reflects a real clinical relationship rather than a form submission.

  3. Day 30+

    Letter may be issued

    Only after the minimum period may the provider issue ESA documentation, and only where it is clinically appropriate. Approval is never automatic even once the clock has run.

  4. After

    Submit to your housing provider

    Send a written reasonable-accommodation request with the letter attached and offer the verification route. Keep the dated copy.

What a California landlord may and may not charge

California rental listings routinely quote pet rent of $25–$100 a month plus a pet deposit on top. Once an assistance animal accommodation is approved, those particular lines come off — while California's ordinary deposit rules carry on untouched.

Already paying pet rent in California?

Do not argue the Fair Housing Act in the abstract — anchor it to the approval date, which is a fact the office cannot dispute: “My accommodation was approved on [date]. Pet rent of [amount] has posted on [dates] since. Please remove it going forward and confirm how the amounts already collected will be credited. I remain responsible for any damage.”

Validity and renewal

How long a California ESA letter lasts — and why AB 468 complicates renewal

No California statute stamps an expiry date on an ESA letter. Housing providers nonetheless treat anything older than about a year as stale, so the working answer is twelve months even though the legal answer is “never”.

The California-specific trap is AB 468. Because the law requires a 30-day client relationship before a letter is issued, switching to a new provider at renewal restarts that clock. Renew with the clinician who already knows you, or start the process a clear month before you need the document.

  1. Month 10Book the renewal review. Early enough that the 30-day rule cannot bite even if you change provider.
  2. Month 11Fresh clinical assessment. A renewal is a genuine re-evaluation, not a reprint with a new date on it.
  3. Month 12New letter in hand before the old one is questioned. Send it to the leasing office unprompted at renewal time.

Moving to California from another state? Your previous letter is useful background, but a California landlord will check that the licence is Californian. Budget for the 30-day relationship period before you sign a lease.

Different pathway

Psychiatric service dogs in California

AB 468 targets emotional support animal documentation. A psychiatric service dog is a different legal animal entirely: status comes from individual task training under the ADA, and public access follows that training rather than any paperwork.

California also penalises knowingly misrepresenting an animal as a service animal. Accurate task documentation protects legitimate handlers from the suspicion those laws create — and a clinician evaluating you must still hold a California licence.

Can I get a same-day ESA letter in California?

No. AB 468 requires a client-provider relationship of at least 30 days before an ESA letter may be issued. Any site offering a Californian an instant letter is either ignoring the requirement or is not licensed in California — and a letter issued in breach of it is exactly the kind a landlord can challenge.

Does the 30-day rule apply to psychiatric service dogs?

The requirement is directed at emotional support animal documentation. A PSD evaluation addresses trained tasks under the ADA and follows a separate pathway, though the clinician must still be licensed in California.

I already have a therapist. Does that count toward the 30 days?

An existing relationship with a California-licensed provider is exactly what the statute contemplates. If your own therapist is willing to write the letter, that is often the fastest route available to you.

Can a California landlord charge pet rent for an approved ESA?

Pet rent, pet fees and pet deposits generally do not apply once an accommodation is approved, because the animal is not being kept as a pet under that policy. You remain liable for actual damage.

My letter is from another state. Is it valid in California?

Housing providers look for a professional licensed where you live. After moving to California it is normal to obtain fresh documentation from a California-licensed provider — and the 30-day clock applies to that new relationship, so start early.

How quickly can I get ESA documentation in California?

Budget days, not minutes. A completed intake reviewed by a California-licensed clinician typically issues within 24 to 48 hours. Any service promising an instant letter with no review is selling the kind of document California landlords reject.

Is there an official ESA registry or certificate in California?

No. California operates no emotional support animal registry, and no ID card, vest, certificate or registration number creates housing rights anywhere in the United States. The assessment is of the clinician's letter; the vests, tags and cards sold with it change nothing legally.

Do two animals need separate documentation in California?

More than one is possible in California, but each animal has to be justified. A letter that gestures at pets in general is the version that gets refused.

What should I expect to pay for California ESA documentation?
