Texas Security Deposit Refund Rules Still Apply to You

Removing pet charges does not change how your ordinary security deposit works. Texas Property Code Chapter 92 sets the move-out rules every tenant should know.

A landlord who keeps a deposit in bad faith can owe $100, three times the amount wrongfully withheld and reasonable attorney's fees. Missing the 30-day deadline creates a presumption of bad faith.

Do not skip last month's rent

Texas tenants may not withhold the final month's rent on the theory that the deposit covers it, and doing so in bad faith carries its own penalty.

Texas sets no maximum security deposit amount. A refundable pet deposit is generally treated as part of the security deposit for these rules.

Service Animals, Hotels and Surcharges

Rental housing

Service dogs are assistance animals under the Fair Housing Act and the Texas Fair Housing Act, so pet deposits, pet fees and pet rent generally do not apply to them.

Hotels, restaurants and stores

Under the ADA, a business may not add a surcharge for a service animal even when pets pay a fee. A hotel can still bill for damage if it bills other guests for damage they cause.
