What that does to an annual tenant

Short-let economics squeeze the long-term market

When a unit earns more in event weeks than it does in months of ordinary letting, some owners stop offering annual leases entirely and others offer them only for the parts of the year that suit. The result across Volusia is fewer long-term units, more nine and ten-month terms, and landlords who know that a departing tenant is easily replaced.

That imbalance is why people here tell us they hesitated before asking. The worry is not usually that the request will be refused outright — it is that a landlord with options will simply decline to renew at the end of the term and say nothing about why.

The protection is the same one that works everywhere, and it works better here than people expect: make the request in writing, date it, and keep the reply. Retaliating against a tenant for a good-faith accommodation request is unlawful, and a non-renewal landing shortly after a request creates a sequence that speaks for itself.

Beachside and mainland are different markets

Beachside

The peninsula, Ormond and Ponce Inlet

Older condominium stock, much of it built decades ago, mixed between resident owners, seasonal owners and holiday letting. Associations here are frequently small, self-managed and run by long-standing residents.

Requests tend to go to a volunteer board that meets irregularly. Expect slower answers, less familiarity with the rule, and a good response to a calm written explanation rather than a confrontational one.

Mainland

Holly Hill, Port Orange, Deltona, DeLand

Where most year-round tenants actually live. Single-family rentals, duplexes and modest apartment blocks, let by individual owners and small local agents largely untouched by the event calendar.

Decisions come faster and more informally. The obstacle is unfamiliarity rather than process, and information usually does more work than argument.

I am worried my landlord just will not renew if I ask. Is that a real risk?
The worry is understandable in a market this tight, and the law addresses it directly: punishing a tenant for having asked in good faith is itself prohibited. What protects you day to day is paperwork — a request carrying a date and a reply carrying one too. Should a non-renewal land soon afterwards, that ordering is the evidence.
My lease is only nine months. Does an accommodation still apply?
Yes. The duty to consider a reasonable accommodation does not depend on the length of the term. What a shorter term changes is practical timing: raise it when you sign, not two months before the end.
The building bans all animals and has since the seventies.
The age of a declaration is irrelevant to whether federal housing law reaches it. A blanket ban is simply a rule, and rules are what accommodations depart from. The board has to weigh the request on what it says.
My unit is let short-term during Bike Week and I move out for it. What then?
Your accommodation attaches to your occupancy of the dwelling. Where you are genuinely absent and the unit is let to someone else, the arrangement is unusual enough that the terms need reading carefully — including what happens to the animal during that period, which is a practical question the lease may simply not address.
The association has no management company and no form. How do I submit?
In writing to the board, however informally it operates, with the documentation attached and a courteous date for a reply. Where there is no process, your letter is the process, and a copy of it is the only record that will exist.
Is there a Volusia County ESA registry?
