Colorado Service Dog Laws: Public Access, Trainers and Misrepresentation

Colorado follows the ADA's definition of a service animal and then adds its own protections for trainers, workers and handlers, along with a fine that grows for people who fake it.

What Counts as a Service Dog in Colorado

Colorado ties its service animal rights to the federal ADA definition. The test is about training and function, not breed, size or paperwork.

Three questions that decide it

Does the handler have a disability?Physical, psychiatric, sensory, intellectual or other mental disability.
Is the dog individually trained?To do work or perform tasks directly related to that disability.
Is the dog under control?Usually harnessed or leashed, and housebroken.

Not service animals in public places

Two Questions, Three Limits for Colorado Businesses

When a dog's job is not obvious, staff may ask only:

Is the dog required because of a disability?
What work or task has the dog been trained to perform?
  • No documentation demands. Businesses may not require certificates, letters or ID.
  • No demonstrations. The dog does not have to show its task on request.
  • Removal only for conduct. A dog that is out of control or not housebroken can be excluded, and the customer still gets served.

Federal law protects fully trained dogs. Colorado goes further by protecting the training period itself.

No certificate is required at any stage. Owner-training is allowed, and professional help is common.

Colorado's Escalating Fine for Faking a Service Animal

C.R.S. 18-13-107.3 targets intentional misrepresentation, and only after the person has been warned.

The statute covers intentional misrepresentation of entitlement to an assistance animal.

Psychiatric Service Dogs in Colorado

A dog trained to perform tasks for a mental health condition is a service dog, with the same public access as a guide dog. Documentation from a clinician helps in housing, where the need may not be obvious.

Colorado Service Dog Questions

Do service dogs need to be certified or registered in Colorado?

No. Neither the ADA nor Colorado law requires certification, registration, an ID card or a vest. What matters is that the dog is individually trained to do work or perform tasks for a person with a disability and stays under control.

Are service dogs in training protected in Colorado?

Yes. C.R.S. 24-34-803 gives a trainer, or a person with a disability, accompanied by a service animal in training the right to be accompanied without an extra charge in places of employment, housing, public accommodation and public programs.

What is the penalty for faking a service dog in Colorado?

Under C.R.S. 18-13-107.3, intentionally misrepresenting entitlement to an assistance animal after receiving a warning is punished by a $25 fine for a first offense, $50 to $200 for a second, and $100 to $500 for a third or later offense.

Can a Colorado business ask for proof that my dog is a service dog?

When the dog's role is not obvious, staff may ask whether the dog is required because of a disability and what task it has been trained to perform. They may not require documentation or ask the dog to demonstrate its task.

Can my Colorado employer refuse my service dog?

Colorado law requires an employer to allow an employee with a disability who is accompanied by a service animal to keep the service animal with them at all times.

Do Colorado service dogs pay dog license fees?

No. A person with a disability who owns a service animal is exempt from state and local licensing fees or charges for it, although vaccination requirements still apply.
