Apartment or rental home

HOA-governed subdivision

Common problem: a board that believes recorded covenants outrank fair housing duties. They do not.

What helps: following their process exactly, then asking for a decision date in writing. Board meeting cycles are the usual source of delay.

Manufactured-home community

Common problem: rules treated as absolute because they have never been challenged, plus breed policies applied by habit.

What helps: stating plainly that this is a reasonable-accommodation request rather than a request for permission to keep a pet.

The recurring myth

“Our covenants say no pets”

This is the single most common response Mississippi HOA residents receive, and it misses the point in the same way a landlord’s no-pets policy does. An approved assistance animal is not being kept as a pet under that covenant.

Associations are generally subject to reasonable-accommodation duties. A recorded covenant does not sit above federal fair housing law, and boards usually accept that once it is put to them politely in writing.

Mississippi does not cap residential security deposits by statute, which means the lease governs and the pet addendum can run to several separate charges. Jackson and Gulfport buildings frequently stack a fee, a deposit and monthly pet rent on the same tenancy.

All of those exist because the lease treats the animal as a pet. An approved assistance animal is not held as a pet under that policy, so the charges built on it stop applying — whatever they are called on the statement.

What does not change is everything arising from the tenancy itself. Your security deposit is unaffected, your rent is unaffected, and you remain fully responsible for any damage the animal causes. Mississippi landlords keep every ordinary remedy for that.
