The request, start to finish

Five stages, and the two where West Virginia requests usually stall.

Nothing here is unique to us — this is the sequence a Charleston or Morgantown property manager expects to see.

  1. 01

    Free screening

A few minutes online. It establishes whether a clinical evaluation is worth pursuing before any money changes hands.

  2. 02

Evaluation with a West Virginia-licensed clinician

The stage most often skipped by cheap providers. Licensure follows where you live, and an out-of-state credential is the single most common reason a West Virginia landlord refuses documentation.

    Common failure point
  3. 03

    Decision and letter

Approval is never automatic. The clinician may approve, decline, or ask for more information — that exchange is a sign of genuine review.

  4. 04

Written request to the housing provider

Send the letter with a short written accommodation request and keep a dated copy. Verbal requests at the leasing desk leave no record when the story changes later.

    Common failure point
  5. 05

    Verification, then a decision

A provider may confirm the documentation is genuine. It may not demand your diagnosis or treatment notes to do so.

Choosing the right route

ESA letter or psychiatric service dog in West Virginia?

The two are governed by different statutes and reach different places. Picking the wrong one is why requests get refused.

What West Virginia law adds to the federal floor.

The West Virginia Human Rights Act (W. Va. Code § 5-11) prohibits disability-based housing discrimination and requires reasonable accommodation, running alongside the federal Fair Housing Act rather than replacing it. The West Virginia Human Rights Commission investigates state complaints; HUD handles the federal route.

West Virginia also treats misrepresenting an animal as a service animal as an offence. That cuts both ways: it protects legitimate handlers from the credibility damage done by fake vests, and it is a reason to be accurate about whether your animal is task-trained.

Why telehealth matters more here.

Much of West Virginia sits an hour or more from the nearest mental-health practice, and the counties with the thinnest provider coverage are often the ones with the highest need. A secure online evaluation removes the drive without lowering the clinical bar.

If your connection is unreliable, tell us during intake. Evaluations can usually be arranged around bandwidth limits rather than abandoned because of them.

West Virginia questions

West Virginia ESA and PSD questions

Does West Virginia have its own ESA statute?

Not a standalone one. Requests rest on the federal Fair Housing Act, with the West Virginia Human Rights Act (W. Va. Code § 5-11) supplying the state discrimination route and the Human Rights Commission the state complaint process.

Can a Morgantown landlord refuse an ESA near WVU because the building is student housing?

Student status is not itself a reason to refuse. Campus and off-campus residential housing is generally covered, so a documented request should be assessed on its merits. Purpose-built student blocks sometimes apply pet policies reflexively — that is a policy, not a legal answer.

What happens if I am charged pet rent after approval?

Raise it in writing and reference the approved accommodation. Pet rent, pet fees and pet deposits generally stop applying to an approved assistance animal, though you remain responsible for damage the animal actually causes.

Is a letter from a therapist in Ohio or Pennsylvania acceptable?

Usually not. West Virginia housing providers check that the clinician is licensed for West Virginia, and it takes a leasing office about a minute to confirm. Get fresh documentation from a West Virginia-licensed professional before you need it.

Do I have to tell my landlord my diagnosis?

No. A housing provider may seek enough information to evaluate the request and confirm the documentation is genuine. It should not require diagnosis labels, treatment notes or unrelated medical records.

How long is a West Virginia ESA letter good for?

No statute sets an expiry. Leasing offices generally treat documentation older than about twelve months as no longer evidence of a current need, so renewing before that point avoids the argument entirely.

Licensure is checked against your county, not your postcode

In a state where the nearest practice may be in another state entirely, the temptation to accept an out-of-state credential is real. Allocation refuses it, because a West Virginia landlord will too.
