Washington attaches a civil penalty to faking it.
Under RCW 49.60.214 a person who misrepresents an animal as a service animal can face a civil penalty of up to $500. Washington is one of a minority of states to put a number on it, and the reason is straightforward: fraudulent vests and online certificates were making life harder for handlers with genuinely task-trained dogs.
That law works in your favour if your documentation is real. It is also a good reason to be precise about whether you have an emotional support animal or a psychiatric service dog, because in Washington the distinction has a price attached.
If you are the tenant
- Establish which category you are actually in before you write to anyone.
- Get documentation from a clinician licensed for Washington, dated recently.
- Submit a written accommodation request and keep a dated copy of everything.
- If refused, ask for the specific reason in writing before doing anything else.
If you are the housing provider
- You may confirm the documentation is genuine and the clinician is licensed.
- You may ask about the animal’s behaviour, control and house-training.
- You may not require a diagnosis, treatment notes or a registration number.
- You may not apply pet rent, pet deposits or breed caps once approved.

Psychiatric service dogs

The evaluation records the clinical need behind trained work your dog already performs. What creates the access right is the training itself — not the evaluation, and certainly not a purchased certificate, which in Washington may cost you $500 rather than protect you.
What qualifies as work
Deep pressure during a panic episode, interrupting dissociation, medication reminders, room search before entry, guiding the handler out of an overwhelming environment.
What does not
Comfort from the dog’s presence, emotional steadiness without a trained action, or any behaviour the dog would perform anyway. That is an emotional support animal, and it is protected differently.

Could I really be fined for taking my ESA into a Seattle shop?
The penalty applies to knowingly misrepresenting the animal as a service animal. Being refused entry is the ordinary outcome; the penalty is aimed at people who assert service-animal status to get access they are not entitled to.
Does a Portland clinician’s letter work in Vancouver, Washington?
Usually not, despite the distance being a few minutes. Licensure follows the state you live in, and a Washington housing provider checks for a Washington licence regardless of how close the clinician is.
Can a Tacoma landlord charge a pet deposit after approval?
Not for the approved animal. Pet deposits, pet rent and breed surcharges generally stop applying once the accommodation is granted. The standard security deposit and your liability for damage are unaffected.
Will UW or WSU housing accept an ESA letter?
Campus residence halls are generally covered housing and a documented request is normally assessed the same way. Both universities run their own disability-services process with deadlines, so apply early rather than at move-in.
How long does documentation stay current in Washington?
No statute sets an expiry. Leasing offices apply their own standard and most stop treating a letter as evidence of a current need past roughly twelve months, so renewing ahead of that avoids the argument.
Which complaint route should I use if I am refused?
The Washington State Human Rights Commission and HUD both accept housing complaints, and Seattle residents can also go to the city’s Office for Civil Rights. You do not need to choose more than one at the outset; start with the written reason for refusal.
