When and How to Renew an ESA Letter in South Carolina

South Carolina's statute says nothing about a letter going stale. Leases, though, run on calendars, and landlords tend to ask for something recent when a lease comes up for renewal. Plan your next evaluation around your lease, not around a deadline the law never set.

Common practice
About 12 months

How recent many landlords want a letter to be. This comes from landlord practice, not from state law.

Three Views of a Letter's Shelf Life

The statute

No date is written into the law

S.C. Code 31-21-70(N) lets a landlord request documentation that verifies your answers to two questions. It does not say how old that documentation may be.

The landlord

Recent is easier to accept

Property managers often ask for a letter from the last year, especially at renewal time or when a new company takes over the building.

The clinician

A letter describes a moment

It reflects the clinician's assessment when it was written. If your condition or your animal has changed, an older letter says less about your life now.

Plan the Date of Your Next Letter

Enter the date on your current letter and the day your lease ends. The planner suggests when to book a re-evaluation.

Signs It Is Time for a Fresh Evaluation

Any one of these is a good reason to book a new appointment instead of sending the old letter again.

A moveA new landlord is starting from scratch with your request.
A lease renewalRenewal paperwork is often when property managers ask for updates.
A new or second animalThe letter should cover the animal you actually live with.
A change in your conditionYour needs may be different from when the letter was written.
A change in your clinicianIf the writer retired or moved, verification gets harder.
New managementA new company may review every accommodation on file again.

Moving From One South Carolina City to Another

A move from Columbia to Greenville, or from Rock Hill to the coast, means a new landlord and a new request. Your letter does not transfer on its own.

If your letter is only a few months old and still accurate, you can usually send it with the new request. If it is older, or your life has changed, a re-evaluation before you apply heads off questions and keeps move-in on schedule.

Keep a Simple Renewal File

A folder, paper or digital, makes each renewal quicker. Tick off what you already have:

Renewing When You Have Two Animals

A landlord looks at each animal as its own accommodation. If you now live with a second animal, the renewed letter should explain the need each one meets.

Your clinician will not add an animal just because it lives with you. Documentation follows what the evaluation supports.

Renewal Questions From South Carolina Tenants

01

Do ESA letters expire in South Carolina?

No South Carolina statute gives an ESA letter an expiration date. A landlord may still ask for documentation that reflects your current need, and many housing providers look for a letter written within the past year.

02

How often should I renew my ESA letter?

Many people schedule a re-evaluation once a year, or before signing a new lease or moving. Renewing before your landlord asks keeps a lease renewal from stalling.

03

Can my landlord ask for a new ESA letter every year?

A landlord can ask for documentation that reflects your current situation, and some ask at each lease renewal. Asking for an update is not a denial on its own, but repeated demands for information you have already provided may be unreasonable.

04

Do I need a new ESA letter if I move within South Carolina?

You need to make a new request to the new landlord. A recent letter can often be reused, but an older one may prompt the new landlord to ask for something current.

05

Does renewing an ESA letter require a new evaluation?

Yes. A renewed letter should reflect a clinician's current assessment of your disability and your need for the animal, not a copy of the old letter with a new date.

06

What should a renewed ESA letter include?

The same things as the first one: the clinician's license details and contact information, a statement that you have a disability, a statement that the animal meets a disability-related need, a current date and a signature.
