Flagler has grown almost entirely from arrivals, a great many from states whose landlord-tenant law works nothing like Florida's. People turn up confident about rules that no longer apply, and the gap is where the trouble starts.

The federal floor is the same in every state

The Fair Housing Act is federal law. The obligation to consider a reasonable accommodation for an assistance animal, the rule that an approved assistance animal is not a pet, the exemption from pet deposits and pet rent, the inapplicability of breed and weight limits — none of that changes at a state line.

So if you held an accommodation in New York or New Jersey or Ohio, the underlying right is the same here. That is the reassuring half, and it is worth knowing before reading the rest of this page.

What differs is everything layered on top: what a state adds, what local practice expects, and how providers behave. In Florida those differences are unusually pronounced, in both directions.

More protection and more scrutiny, at the same time

Arrivals often assume a state that legislated specifically on assistance animals must have done so to restrict them. In practice § 760.27 does something more useful: it says plainly what a provider may ask for, which means a request meeting that standard is harder to brush aside than in a state where everyone is improvising.

The same statute also attaches criminal exposure to knowingly false documentation, and that has shaped the culture. Florida landlords and boards have seen a great deal of purchased paperwork and have become correspondingly suspicious of anything that looks manufactured.

The practical consequence for a new arrival is simple. Documentation that would have passed without comment where you came from may be examined closely here — not because your need is doubted, but because the market has trained people to look.

Because Florida legislated specifically in this area and made false documentation a criminal matter, which has trained providers to check. The first thing they check is the licence number, and an out-of-state one returns nothing on the Florida register. It is not a judgement about you.
Do I have to start completely from scratch?
Not from scratch. The underlying right is unchanged and your history is real. What a fresh assessment by a Florida-licensed practitioner gives you is documentation that a local provider can verify in a minute, which is what removes the argument.
Is Florida better or worse than where I came from?
Genuinely mixed. On assistance animals specifically, a state statute setting out what may be requested is helpful — it is harder for a provider to improvise. On tenancy more broadly, Florida offers considerably less than heavily regulated markets do, and that comes as a shock to a lot of arrivals. The two are separate subjects.
Our new community has a declaration banning animals over forty pounds.
A weight cap written into a pet covenant has no effect on an approved assistance animal, no matter how recently the declaration was recorded. Ask for the community's accommodation form by name rather than the pet registration form, and submit it with the letter and licence number.
How soon after moving should I do this?
Before signing if you can, and certainly before the animal arrives. A request made alongside the tenancy reads as part of it; the same request three months later reads as a change to it.
Is there a Flagler County ESA register?
