New Jersey gives renters more than the federal act does
The Law Against Discrimination is one of the broadest state anti-discrimination statutes in the country, and in housing it reaches situations the federal Fair Housing Act leaves out. For a New Jersey renter that is not a technicality - it is the difference between having a claim and not having one.
So when a landlord tells you that a federal exemption applies to their building, the follow-up question is whether the LAD applies anyway. Frequently it does, and the Division on Civil Rights is where that gets tested.
What that breadth looks like in practice
Fewer gaps in coverage. Small-property exemptions that limit the federal act do not map neatly onto the LAD, so an assumption based on federal rules alone may be wrong here.
A state enforcement body that takes complaints directly. The Division on Civil Rights investigates without waiting for HUD, and filing costs nothing.
Condominium and co-op boards are not outside it. A board with its own rulebook is still subject to the statute when it decides your request.
Written refusals matter. Whatever route you use afterwards, the reason you were given in writing is the exhibit that carries the case.
The commuter problem in Hudson and Bergen counties
An enormous number of Jersey City, Hoboken, Fort Lee and Newark residents work in Manhattan and see a therapist there. That relationship may be long-standing and entirely genuine, and it still does not produce documentation a New Jersey landlord will accept.
The licence has to cover New Jersey, because New Jersey is where you live. Crossing the Hudson twice a day changes nothing about that, and it is the single most common reason a request from this corner of the state gets bounced.
Older housing stock, newer rules
Much of Paterson, Elizabeth, Camden and Trenton sits in buildings that predate every rule discussed here. Landlords sometimes offer the building's age or its insurance as the reason nothing can be done.
Neither is an answer by itself. A refusal has to identify something specific and real about your request, and if it cannot, the request has not properly been considered.

How do I get an ESA letter in New Jersey?
Take the free screening first. If it points toward an evaluation, a New Jersey-licensed clinician carries one out by video and issues a letter where the assessment supports it.
My therapist is in New York City. Can I use their letter in Hoboken?
Generally not. Your housing is in New Jersey, so the clinician needs a New Jersey licence. This is the most frequent obstacle for commuters and the easiest to fix in advance.
My landlord says their small building is exempt. Is that right?
It may be true of the federal act and untrue of the Law Against Discrimination, which reaches more situations. Do not accept a federal exemption as the end of the matter without checking the state position.
Can my condo board impose extra conditions?
It can verify the clinician's licence and ask what need the animal addresses. It cannot demand your medical records, charge a fee to consider the request, or apply the pet policy's fees to an approved animal.
Where do I complain if I am refused?
The New Jersey Division on Civil Rights takes complaints under the LAD, and HUD takes them under the federal act. Neither charges a filing fee.
How recent does my New Jersey letter need to be?
No statute sets a limit. Buildings here commonly expect documentation from within the past year, and in this rental market a current letter is simply a stronger application.
