Illinois legislated the verification question

The Assistance Animal Integrity Act sets out what a housing provider may ask for — and what it may not.

Illinois is one of the few states to write the documentation question into statute rather than leaving it to fair-housing custom. The Act allows a housing provider to request reliable documentation of the disability-related need where that need is not readily apparent, and it makes clear the provider is entitled to enough information to evaluate the request — not to the underlying medical record.

The practical consequence is that an Illinois leasing office generally knows it may ask for something, which makes an incomplete letter more likely to be challenged here than in a state with no such statute. It also means a provider demanding your diagnosis is exceeding what the Act contemplates.

What an Illinois provider may do

  • Request reliable documentation from a licensed professional where the need is not apparent
  • Verify the clinician is genuine and holds a current Illinois licence
  • Ask about the specific animal’s behaviour, control and house-training
  • Refuse where the individual animal poses a genuine direct threat

What it may not do

  • Require your diagnosis, treatment notes or medication list
  • Insist on a registration number, certificate, vest or ID card
  • Apply pet rent, a pet deposit or a breed surcharge once approved
  • Refuse on the strength of a no-pets policy alone

Chicago residents have an extra route

Alongside the Illinois Department of Human Rights and HUD, the Chicago Commission on Human Relations enforces the city’s own fair housing ordinance and takes complaints directly from residents. For a Chicago tenant that often means a local investigator rather than a state queue. It does not change what your documentation must contain — only who will read a refusal.

Psychiatric service dogs

A different statute, a different test.

The Assistance Animal Integrity Act addresses documentation for assistance animals in housing. Public access for a psychiatric service dog is an ADA question, and there the test is whether the dog is individually trained to perform disability-related work.

Does Illinois really have an assistance animal statute?

Yes. The Assistance Animal Integrity Act sets out the documentation a housing provider may request and the limits on that request, working alongside the Illinois Human Rights Act and the federal Fair Housing Act.

Can a Chicago landlord charge pet rent after approving my ESA?

Once the accommodation is granted the animal stops being a pet for billing purposes, so monthly pet rent, the pet deposit and any breed surcharge fall away. Everything charged to every tenant stays: the standard deposit, and the cost of repairing whatever your animal actually damages.

Will a letter from an Indiana or Wisconsin clinician work here?

Usually not. Illinois housing providers check that the signing clinician holds a current Illinois licence, and an out-of-state credential is among the easiest grounds on which to refuse.

My building asked for my diagnosis. Do I have to give it?

No. The Act contemplates enough information to evaluate the request, not the medical record behind it. A written reply declining to provide a diagnosis while offering verification of the letter is usually the right response.

Does U of I or Northwestern housing have to accept an ESA?

Campus residence halls are generally covered housing and a documented request is assessed under the same framework. Each institution runs its own accessibility process with deadlines, so file early rather than at move-in.

Is there an expiry date on an Illinois ESA letter?

Nothing in Illinois law retires one. What ends it in practice is a management company's own convention, and the larger Chicago operators treat anything past a lease cycle as describing a situation they can no longer verify.
