California AB 468 rewrote how ESA documentation works.

Most states leave emotional support animal documentation to general fair-housing principles. California did not. Effective January 2022, AB 468 wrote specific obligations into the Health and Safety Code for anyone providing ESA documentation to a California resident — and it put teeth behind them.

The practical effect is that a great many national websites simply cannot lawfully serve California. If a provider offers you a same-day California ESA letter, that offer is the clearest possible signal it is not following the statute.

What the 30-day rule means for your timeline

It means nobody can lawfully hand you a California ESA letter today. If you need documentation for a lease starting next month, the time to begin the client relationship is now — not the week the landlord asks. This is the single most common reason Californians end up with documentation a housing provider rejects.

Housing protection in California

The federal Fair Housing Act and the California Fair Employment and Housing Act both require housing providers to consider a reasonable-accommodation request for an assistance animal.

The Civil Rights Department investigates state housing complaints. HUD handles the federal route, and the two operate independently of one another.

Psychiatric service dogs are separate

AB 468 governs emotional support animal documentation. A psychiatric service dog is an ADA matter, resting on the dog being individually trained to perform disability-related work.

The training creates the public-access right. A clinical evaluation records the need behind it, and California recognises no certificate or registry that substitutes for either.

Can I get a California ESA letter today?

Not lawfully. AB 468 requires a client relationship of at least 30 days before ESA documentation is issued. Any site promising an instant California letter is either ignoring the statute or is not actually issuing California-compliant documentation.

Does AB 468 apply to psychiatric service dogs?

No. It addresses emotional support animal documentation specifically. A psychiatric service dog is governed by the ADA, where what matters is the dog’s individually trained work rather than any document.

My letter is from an out-of-state provider. Is it valid in Los Angeles?

Almost certainly not. AB 468 requires a California-licensed practitioner, and a Los Angeles or San Francisco leasing office is generally aware of that requirement. An out-of-state credential fails the statute before anyone examines the clinical content.

Can my landlord charge pet rent once the ESA is approved?

Not for the approved animal. Pet rent, pet fees and breed or weight surcharges generally stop applying, though your ordinary security deposit and your liability for damage the animal causes are unaffected.

Will UC or CSU housing accept an ESA letter?

Campus residence halls are generally covered housing and a documented request is normally assessed under the same framework. Each campus runs its own disability-services process, and California’s 30-day rule means applying early matters more here than almost anywhere else.

What if a provider offers to backdate the relationship?

Walk away. That is a straightforward attempt to evade AB 468, it puts the practitioner’s licence at risk, and documentation produced that way is worth nothing to you the moment a housing provider examines it.
